This document is an electronic record in terms of Information Technology Act, 2000 and rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures. Not withstanding anything contained or said in any other document, if there is a conflict between the terms mentioned herein below and any other document, the terms contained in the present T&C shall alone prevail for the purposes of usage of the site.

Dr. M Holistic Wellness LLP is a body corporate that provides you with the best products in the Ayurveda, therapeutic, general body & wellness category. Through this website we offer a plethora of services including that of selling, buying, accepting orders, dispatching and delivering of massage oils, therapy oils and aroma oils as showcased and offered on the website in India and abroad.

INDEMNITY

You shall indemnify and hold harmless Dr. M Holistic Wellness LLP, its owner, licensee, affiliates, subsidiaries, group companies (as applicable) and their respective officers, directors, agents, and employees, from any claim or demand, or actions including reasonable attorneys' fees, made by any third party or penalty imposed due to or arising out of your breach of this Terms of Use, privacy Policy and other policies, or your violation of any law, rules or regulations or the rights (including infringement of intellectual property rights) of a third party.

If you use the platform, you shall be responsible for maintaining the confidentiality of your Display Name and Password and you shall be responsible for all activities that occur under your Display Name and Password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. You agree that if you provide any information that is untrue, inaccurate, not current or incomplete, we shall have the right to indefinitely suspend or terminate or block access of your membership on the platform.

TERMINATION

If you or Dr. M Holistic Wellness LLP terminates your use of the website or any service, Dr. M Holistic Wellness LLP may delete any content or other materials relating to your use of the service and Dr. M Holistic Wellness LLP will have no liability to you or any third party for doing so. You shall be liable to pay for any service or product that you have already ordered till the time of termination by either party whatsoever. Further, you shall be entitled to your royalty benefits as per the policy that has or is legally deemed accrued to you.

SERVABILITY

If any provision of the Terms is determined to be invalid or unenforceable in whole or in part, such invalidity or unenforceability shall attach only to such provision or part of such provision and the remaining part of such provision and all other provisions of these Terms shall continue to be in full force and effect.

GOVERNING LAW

This agreement shall be governed by and interpreted and construed in accordance with the laws of India. The place of jurisdiction shall be in a Kakinada in the state of Andhra Pradesh.

DISCLAIMER OF WARRANTIES AND LIABILITY

You acknowledge and undertake that you are accessing the services on the platform and transacting at your own risk and are using your best and prudent judgment before entering into any transactions through Dr. M Holistic Wellness LLP. We shall neither be liable nor responsible for any actions or inactions of sellers nor any breach of conditions, representations or warranties by the sellers or manufacturers of the products and hereby expressly disclaim and any all responsibility and liability in that regard. We shall not mediate or resolve any dispute or disagreement between you and the sellers or manufacturers of the products. We further expressly disclaim any warranties or representations (express or implied) in respect of quality, suitability, accuracy, reliability, completeness, timeliness, performance, safety, merchantability, fitness for a particular purpose, or legality of the products listed or displayed or transacted or the content (including product or pricing information and/or specifications) on platform. While we have taken precautions to avoid inaccuracies in content, this website, all content, information (including the price of products), software, products, services and related graphics are provided as is, without warranty of any kind. At no time shall any right, title or interest in the products sold through or displayed on platform vest with Dr. M Holistic Wellness LLP nor shall Dr. M Holistic Wellness LLP have any obligations or liabilities in respect of any transactions on platform.
